Still Waiting

I was reading the live blog from the SCOTUSblog hoping to see the decision on the D.C. v. Heller case, or more commonly known, the D.C. Gun Ban Case. Looks like the decision will be announced tomorrow.

And it is possible that Justice Scalia is writing the opinion. Could be good news.




Holding out hope, yet.

I hate waiting. I really do. I'm hoping for individual right, but with the way things are going I could see them going collective.

Actually more than likely they'll back down all together and make a non-decision.

I read that too. I'd like to see Scalia write for the majority (which I'm hoping it will be). He writes so that it's easy to understand. Which should be good for the anti-gun crowd.

My gut says to expect very little change. Probably a strike down of the actual ban, but not going much farther. If indeed Scalia is writing a Majority opinion, I think it maybe be better news, striking down not only D.C but effectively making several bad laws go out the window. But the SCOTUSblog suggested there could be a plurality decision, which I think means it could be split 3 ways on the decision.

There are some on the wrong side hoping that the decision will be based on the "reasonable restriction" concept (which has no legal standing as far as I can tell) and then all they have to do is argue what is "reasonable." I don't see this happening.
